No relief to Google from NCLAT, tribunal orders CCI fine of Rs 1,337.76 crore

Google-CCI Issue: Internet company Google has got a shock. The National Company Appellate Tribunal (NCLAT) has upheld the Competition Commission of India’s decision to impose fine on Google. The CCI had imposed a fine of Rs 1,337.76 crore on Google for indulging in anti-competitive activities in the case of Android mobile devices.

Making some improvements in the decision of the Competition Commission of India, a two-member bench of NCLAT has ordered Google to deposit the fine amount within 30 days following the instructions. A bench of NCLAT Chairperson Justice Ashok Bhushan and member Alok Srivastava said, “We are upholding the decision of the fine.” The appellant (Google) is ordered to deposit the remaining fine within 30 days after adjusting the 10 per cent amount already deposited under its order dated January 4.

The bench, while upholding the decision of the Competition Commission, has given Google 30 days to implement it. Along with this, some amendments have also been made in the order issued by the Commission on October 20, 2022. The amendments made to the order of the Competition Commission include some part related to the permission to remove the Google Suite software.

Google had claimed in its petition that the Competition Commission had not conducted a fair investigation against Ulke. The two people on whose complaint the commission started the investigation were working in the same office that was probing Google. According to the company’s plea, the CCI failed to conduct a fair, balanced and legally sound investigation, ignoring evidence from Indian users and app developers.

In the relief given by Google, it will no longer be necessary for Google to host third party apps in the Play Store. Earlier CCI had ordered to do so. Google has got relief from this order of NCLAT.
