The Court observed that during the pendency of the present writ petition, on 27.01.2022 M/s. Talace Pvt. Ltd has acquired 100 percent stake in Air India. Air India is no longer a Government company and is not subject to the jurisdiction of the writ. Because of this, the court cannot entertain the writ petition.

Dismissing the petition, the court said that the petitioner is free to take recourse to the laws before an appropriate forum and if the claim is successful, Air India will be liable to clear the dues. In his petition, the petitioner sought arrears of pay and allowances for the period from January 1, 1997 to July 31, 2006.
