According to a report by news agency PTI, now the Supreme Court has also approved this announcement. The Supreme Court is of the view that if any of your luggage is lost or stolen during the journey, the Railways is not responsible for the same and it cannot be considered as deficiency in service on the part of the Railways.

The court was hearing this matter

The vacation bench of the Supreme Court was hearing a petition against a decision of the National Consumer Disputes Redressal Commission ie NCDRC. In a related case the belongings of a businessman were lost. The businessman had claimed before the District Consumer Forum that he had lost Rs 1 lakh kept in his waist belt while traveling by a train and sought compensation from the Railways for his loss. The NCDRC had directed the Railways to pay Rs one lakh to a businessman.

Protect your own goods

A vacation bench of Justice Vikram Nath and Justice Ahsanuddin Amanullah That order of the National Consumer Disputes Redressal Commission was quashed. The bench said that the theft of someone’s luggage during the train journey cannot be said to be deficient in the service of the railways. Railways cannot be held responsible if the passenger is not able to protect his luggage himself.

Supreme Court made this observation

We understand I fail to explain how theft can be termed as deficiency in service of Railways in any way. Railways cannot be held responsible if the passenger is not able to safeguard his/her baggage.
