Data Protection Bill: The Central Government informed the Supreme Court on Tuesday that the new Data Protection Bill (Data Protection Bill) is ready and will be introduced during the monsoon session of Parliament. The monsoon session of the Parliament begins in July every year and continues till August. The top court was hearing a case related to privacy concerns of social media users.

Attorney General gave information to the constitution bench

Attorney General R Venkataramani told a five-judge constitution bench headed by Justice KM Joseph that the bill is ready and it will address all concerns. Apart from Justice Joseph, the Constitutional Bench includes Justice Ajay Rastogi, Justice Aniruddha Bose, Justice Hrishikesh Roy and Justice CT Ravikumar. The bench took cognizance of the Attorney General’s submissions and directed that the matter be placed before Chief Justice DY Chandrachud, so that a new bench could be constituted, as Justice Joseph is due to retire on June 16. After this, the matter was listed for hearing in the first week of August 2023.

What did the counsel for the petitioners argue?

Senior Advocate Shyam Divan, appearing for the petitioners, argued that the court should not link the court hearing with the legislative process, as on the last three occasions the apex court was told each time that the data protection bill was likely to be passed . He said that the legislative process is complex and it (the bill) may be sent back to some committee.

Attorney General protested

Venkataramani strongly countered Dewan’s submissions, saying consultations are an ongoing process and the data bill has gone through a “very quality consultation process”. Justice Venkataramani said, “Don’t say we are wasting time. We want a better law.”

What did the Supreme Court say in its order

The top court in its order said, “We take note of the submissions of the Attorney General that a Bill to address all concerns will be introduced in the Monsoon Session of Parliament beginning in July this year. request the Hon’ble Chief Justice to place the matter before the Chief Justice so that a Bench may be constituted.”

Petition filed on behalf of two students

The apex court was hearing a petition filed by two students Karmanya Singh Sareen and Shreya Sethi. The petition challenged the contract made between WhatsApp and Facebook to provide access to phone calls, messages, pictures, videos and documents of its users, saying that it was a violation of their privacy and freedom of expression.
